QUITCLAIM DEEDS

If you have the need to transfer title on a piece of real estate, then invariably you will need to create a Quitclaim Deed.

A Quitclaim Deed acts as the document showing the transfer of a piece of property from one person or party to another. Upon the closing of a real estate transaction, the purchaser will tender the purchase price to the seller, who then tenders the Deed to the purchaser. The buyer will then file the Deed with the recorder's office or real estate office in the county where the property is located.

In divorce situations, any change in ownership regarding the real estate that is held within the marriage may necessitate the use of a Quitclaim Deed. If one person is going to keep the home, the other person will need to "quit claim" -- give up -- their portion of the home.

If you prepare a Living Trust or other estate-planning tool (other than a Last Will & Testament,) you must transfer ownership of the real estate into the trust; to do so requires the use of a Quitclaim Deed.

QUITCLAIM DEED
This deed can be used when transferring or conveying property from one party to another without representation or warranties, i.e. generally used in "AS IS" sales.

WARRANTY DEED
This deed is the one most commonly used. This deed "warrants" that the property is being transferred with good title (i.e. without encumbrances except those that are filed on record).

SURVIVORSHIP DEED
In addition to "warranting" that the property is being transferred with good title (without encumbrances except those that are filed on record), the purchasers who take title to this property via this deed also do so "with survivorship," meaning that if one of the purchasers dies the other retains title to the property. This kit also contains a deed that permits one spouse who owns property only in his or her name to transfer that property to both spouses, "with survivorship."
